Evidence

Evidence is relevant if it has any tendency to make a material fact more or less probable than it would be without the evidence (any tendency + of consequence).

Relevant evidence is admissible unless excluded by the Constitution, a federal statute, the FRE, or other rules; irrelevant evidence is never admissible.

Exclude relevant evidence if its probative value is substantially outweighed by danger of unfair prejudice, confusion, misleading the jury, undue delay, waste of time, or cumulative evidence.

An undue tendency to suggest a decision on an improper emotional basis, not merely that the evidence is damaging to the opposing party.

Evidence of a person's character or trait is not admissible to prove that on a particular occasion the person acted in accordance with that character (propensity is barred).
