MPT (Performance Test)

The File (the facts — source documents) and the Library (the legal authority — cases, statutes, regulations, rules). The MPT is a closed universe: everything you need is provided.

Only the law contained in the provided Library. Never import outside law or rules you memorized for the MBE/essays — even if you know them.

Task memo, transcripts of interviews/depositions/hearings, pleadings, correspondence, client documents, contracts, news articles, medical/police records, and the lawyer's notes.

Facts may be irrelevant, ambiguous, incomplete, or conflicting on purpose. Part of the test is sorting them, not trusting them all.

Some authorities (cases, statutes, regulations) that are not relevant to the assigned task. You must select the governing authority and discard the distractors.
